1.2 By accessing the Site, you (the “User” or “you”) signify your acceptance of and obligation to comply with these terms and conditions (the “Terms of Use”), which together with Elizabeth Pepler’s (“my” or “me” or “I”) Privacy Policy governs the relationship I have with you in relation to the Site. Please read these Terms of Use and my Privacy Policy carefully before using the Site.
1.3 If you have objections to these Terms of Use, you should not use the Site.
2.1 The Site is owned and operated by Elizabeth Pepler.
2.2 I reserve the right to update and change these Terms of Use at any time and for any reason. I will alert you to any changes to these Terms of Use by changing the “last updated” date at the bottom of this page, and you waive any right to receive specific notice of each such change.
2.3 It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.
2.4 While I try to make sure that the Site is available for your use, I do not promise that the Site is available at all times, nor do I promise the uninterrupted use by you of the Site.

2.6 This website and my services are not intended for children.
3.1 You may access or use the Site for personal purposes only and may not use it in connection with any commercial endeavours.

(h) You may not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes my rights or those of others.
4.1 Additional terms and conditions (the “Terms of Service”) apply to the delivery of coaching services.
4.2 Should you choose to register for the High Performance Coaching Program (the “Program”) with me, you and I will be required to enter into a separate Coaching Agreement.
4.3 The Terms of Service related to the Program will be communicated to you at the appropriate time and subsequently confirmed to you in writing.
5.1 All images, text, data, graphics, trademarks, service marks, and other Site content and materials (collectively, the “Content”) are copyrighted and owned, controlled or licensed by me, or used with permission of the third-party owner.
5.2 You understand that the use of any of the Content, in whole or in part, and modification of any materials contained on the Site is illegal and may violate the copyright, trademark, and other proprietary rights of Elizabeth Pepler and/or the third-party owner.
5.3 Nothing contained in the Site shall be construed as granting, by implication or otherwise, any license or right to use any trademark or other proprietary information without my express written consent or the consent of the third-party owner.
6.1 This Site contains affiliate links to certain products or services for which I may receive a commission from sales. The majority of the products or services I recommend are things that I personally use, support and would recommend to friends and family.
6.2 Should you wish to purchase a product or service through one of these links, I assume no liability or responsibility for any and all consequences or benefits as a result of you clicking the affiliate links contained on the Site or related communications.
6.3 I will use reasonable efforts to notify you when and where I have placed affiliate links in addition to this disclaimer located in these Terms of Use.
7.1 If at any time I feel that you have violated these Terms of Use, I will immediately terminate your use of the Site and any related communications as I deem appropriate. It is within my sole discretion to allow any user’s access of the Site, and I may revoke this access at any time without notice, and if necessary, block Your IP address from further visits to the Site.
8.1 The Site may include hyperlinks to third-party websites, plug-ins and applications. These links are provided solely as a convenience to you. I do not control these third-party sites and am not responsible for their content or accuracy, including any information or materials contained via these links. I do not endorse these sites unless I specifically state so.

11.3 These Terms of Use are governed by English law and you can bring legal proceedings in respect of the Services in the English courts. If you live in Scotland you can bring legal proceedings in respect of the Services in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the Services in either the Northern Irish or the English courts.
